Privacy Policy regarding Personal Data of Nüpay Users (“Privacy Policy”)

This notice applies to services provided by PT Digital Solusi Pratama (otherwise known as “DSP”, “us”, “ours”) and describes how we may collect , use and disclose “personal data” Users, "personally identifiable information" or other personal information (collectively, “Personal Data”) in connection with User access to and use of the Nüpay application (“Nüpay Application”)

As explained more fully in the Terms and Conditions For Nüpay Users ("Terms and Conditions"), the DSP Mobile Payment Application is basically a digital version of a traditional wallet with many benefits. This is an app that can accommodate your debit and credit cards, vouchers, server-based e-money, gift coupons and reward points, loyalty cards all in one mobile app

Nüpay application is provided free of charge to registered Users. Anyone who does not have a Nüpay Account can register for a Nüpay Account ("Nüpay Account") with DSP. DSP is a non-bank institution that has obtained a license as an electronic wallet service provider under the supervision of Bank Indonesia as the supervising authority

From time to time, the User must provide us with an update of the User Personal Data in connection with the access and use of the Nüpay Application. By agreeing to the Terms and Conditions or by continuing to access or use the Nüpay Application, the User will be deemed to have agreed to and has been aware of the provisions of this Privacy Policy in relation to the collection, use, storage, transfer and disclosure of User Personal Data as stipulated in the Privacy Policy. this.

If the User does not provide us with Personal Data, then we are unable to provide services on the Nüpay Application or to comply with laws and regulations or guidelines issued by authorized officials and agencies

In this Privacy Policy, the word "including" does not have a limited meaning

A. PERSONAL DATA COLLECTION

We may obtain User Personal Data from various sources (e.g. from Users or through third parties) including:

Information obtained (directly or indirectly) about the computer, telephone device or other piece of hardware used to access the Nüpay Application (including the User IP address, geographic location, type and browser/platform version, internet service provider, operating system, referral source/exit page, length of visit/usage, page views and any search terms the User uses) (“Informasi Perangkat”).
Information obtained (by directly or indirectly) when the User creates a Nüpay Account as a user of the Nüpay Application, including the name, date of birth, address, telephone number and electronic mail address of the User (“Informasi Pendaftaran”).
Information obtained ( directly or indirectly) during the use of the Nüpay Account, including billing and shipping information, transaction data, credit/debit card numbers and expiration dates. me and other information derived from checks or money orders (“Informasi Rekening”).
Device Information, Registration Information and Account Information above and other information can be accessed or collected (automatically or manually) when the User creates an Account Nüpay as a Nüpay Application User and/or during the use of Nüpay Application and Nüpay Account. The above information that we obtain may constitute User Personal Data. We have taken steps to ensure that we do not collect User information (whether such information is Personal Data or not) more than what we need to provide our services to Users,
to perform the functions as set out in Section B in this Privacy Policy, to protect User Nüpay Account, comply with our legal obligations, protect our legal rights, and to carry out our business activities.

B. USE OF PERSONAL DATA

We may use the Personal Data we collect about Users for the following purposes:

Verify User eligibility to use the features and functions in the Nüpay Application
Process registration of Users Nüpay Account as Nüpay Application User, maintain and manage registration Users.
rovide services to Users and customer services related to the use of the Nüpay Application, including collaborating with Nüpay to facilitate payments for purchases of goods and services, delivery and other related services for purchases, sending notifications about transactions- User transactions and answer questions, feedback, demands or disputes from Users

To analyze trends, usage and other behaviors (either individually or as a whole) which helps us to better understand how our Users and our collection of users access and use the Nüpay Application and their commercial activities. behind it, including for the purpose of improving services and responding to p customer questions and preferences.
Referring to obtaining User consent in accordance with applicable law as referred to in section D below, we may provide direct marketing information to Users in connection with the services we offer and our affiliates and third parties selected to use Users Personal Data to contact the User, by telephone, short message (SMS), electronic mail, post and facsimile
Managing risk, checking creditworthiness and ability to pay (solvency), or assessing, detecting, investigate, prevent and/or deal with fraud or potentially prohibited or illegal activities and otherwise protect the integrity of our information technology platform.
Detect, investigate, prevent or correct violations of the Terms and Conditions, all internal policies of the Application Nüpay, applicable industry guidelines, guidelines and other relevant laws or regulations.
Make such disclosures as may be required by the laws or regulations of any country applicable to us or our affiliates, government officials or third parties, including card associations or other payment networks . Disclosure may also be made pursuant to a subpoena, court order or other legal process or a requirement in any country that applies to us or our affiliates (including reporting requirements for anti-money laundering and counter-terrorism financing)
Making a disclosure to prevent any harm or financial loss, to report any suspected illegal activities or to face any lawsuits or potential lawsuits brought against us or our affiliates
Conduct due diligence and other assessments or evaluate mergers, takeovers, financing transactions or joint ventures, actual or future.
For other legitimate business purposes such as protecting Users from loss, protecting lives, maintaining the safety of our products and systems and protecting our rights and/or other property.
We may also use Users Personal Data by l ain, which we will accompany with a special notice at the time of such data collection or which has subsequently been approved by the User.

C. DISCLOSURE OF PERSONAL DATA

Users Personal Data that we store will be kept confidential, but we may provide information to the following parties (either within the country or outside the Users country of residence) for the purposes as stipulated in the provisions B.1 to B.13 above

Nüpay accounts and other Nüpay services wholly or partly owned by the group of companies.
Agents, contractors or third-party service providers who work with us in providing services to Users , including for fraud prevention, billing collection, data entry, database management, promotion, marketing, customer service, technology services, product and service notification, and payment extension services.
Entities with whom we have a business reference relationship or other commercial agreements including third parties and entities belonging to PT DSP.
Merchant and other organizations, such as card associations, payment networks or financial institutions, to or through whom such payments are made using the Nüpay Application , or other entities that allow the use of the Nüpay Application.
Financial institutions third parties, banks, acceptance agents and credit agents.
Third party marketing service providers.
Professional advisors, law enforcement agencies, insurance companies, government and authorized officials or other agencies where PT DSP is obliged to make disclosures in accordance with requirements and applicable laws, regulations or commercial arrangements, including arrangements with card associations or payment networks.
Entities involved in mergers, acquisitions, financing transactions or joint ventures with us.

D. DIRECT MARKETING ACTIVITIES

As specified in the provisions of B.7 above, DSP may intend to use Users Personal Data in direct marketing activities (Marketing & Promotion) and in the future, obtain User approval for the planned scope and intended manner of direct marketing activity. If the User then gives such consent, please note that:

Certain Personal Data that we collect from time to time may be used in direct marketing and promotional activities
We may offer Users goods and services, which we believe are relevant to Users, that where further specific User consent will be obtained. This includes goods and services offered by us, one of our affiliates, our business partners or selected third parties, including payment and financial products.
We may provide User Personal Data to certain third parties for use in marketing goods and services. their services, including (i) our affiliates (ii) business partners and (iii) other third parties .
Users consent to the use of Users Personal Data for direct marketing purposes will be obtained by choosing to tick the box or indication other positives that indicate no objection.
At any time the User does not want to continue, use or provide Users Personal Data to other parties for use in direct marketing as described above and in the related agreement, the User can exercise the right of “opt -out” by notifying us

E. SECURITY AND STORAGE MEASURES

We take all reasonable steps and to the maximum extent possible including providing technical, administrative and physical safeguards to help protect the Personal Data of Users that we process, from the risk of loss, misuse and unauthorized access, disclosure , alteration and destruction.

We will retain and ensure our service providers to retain Users Personal Data only for as long as needed for the purposes set out in this Privacy Policy and in accordance with the Privacy Policy and all requirements under applicable regulations.

For Users who are registered in the Nüpay Account, the Registration Information and User Account Information (if any) can be viewed and changed in the Nüpay Application through the Nüpay Account which is protected by a password or PIN code. We remind Users not to reveal their passwords or PIN codes to anyone.

Our employees or officers will never ask for a Users password in unsolicited telephone or e-mail communications. Users ae advised not to store User log-in information (eg: user ID and password) on shared or public computers.

F. THIRD PARTY SERVICES AND WEBSITES

The Nüpay application may provide links to other websites and services (including applications operated by third parties) for User convenience and information. These services and websites may operate separately from us and may have their own notices or privacy policies, we advise Users to read first before undertaking any activity or using the services of such websites. With respect to websites that are not owned or controlled by us, we are not responsible for the content, privacy practices and quality of those services.

G. CHANGES TO PRIVACY POLICY

We reserve the exclusive right to change, add or revise this notice and information from time to time.

H. STOP RECEIVING E-MAIL NOTIFICATIONS

We have a policy of opting in or out of the database. If the User wants to stop receiving emails from us, please click on the unsubscribe link included in each email.

I. OTHER TERMS

This Personal Data Regulation is subject to, regulated and implemented in accordance with the laws of the Republic of Indonesia
In the event of a dispute in the interpretation and implementation of this Privacy Policy, the User and DSP agree to resolve it by deliberation consensus. If the dispute cannot be resolved through such deliberation, then the dispute must be resolved in the South Jakarta District Court.
This Personal Data Regulation is made in Indonesian and English. In the event of a discrepancy between the English version and the Indonesian language version, the Indonesian version will prevail.
We do not guarantee the security of our database and do not guarantee that the data that the User provides will not be disrupted while it is being sent to us. Any transmission of information by the User to us is at the Users own risk. The user may not reveal the password to anyone. No matter how effective a technology is, no security system is impenetrable
J. STATEMENT

By using the Nüpay Application, the User acknowledges that the User has read and understands this Privacy Policy and agrees to the use, processing and transfer of Personal Data as set out in this Privacy Policy.
